Newborns’ & Mother’s Health Protection Act (Newborn’s Act)

McLeod does not restrict benefits for any hospital length of stay in connection with childbirth for the mother or newborn child, to less than 48 hours following a normal delivery or less than 96 hours following a Cesarean delivery. However, the mother’s or newborn’s attending physician or care provider may, after consulting with the mother, discharge the mother or her newborn earlier than 48 hours (or 96, as applicable). McLeod does not require a provider to obtain authorization for prescribing a length of stay that is 48 hours (or 96 hours following a Cesarean delivery). Certain notice requirements of the pregnancy or the childbirth may apply.
